Tony Eden, civil litigation and estate dispute lawyer, recently received reasons for judgment from the Supreme Court of British Columbia in Reimer v. Reimer, 2026 BCSC 60, a complex estate litigation matter. The Court largely accepted our client’s position and imposed a substantial resulting trust in favour of the estate.

 

Estate disputes of this nature are rarely straightforward. They often arise at the intersection of legal doctrine, family relationships, fiduciary duties, and issues associated with aging and vulnerability. In this case, the Court undertook a detailed review of the evidence and credibility of the parties, ultimately emphasizing the importance of transparency and accountability where significant assets are transferred during a testator’s lifetime.

 

While all estate disputes and litigation outcomes are inherently fact-specific, this decision underscores the careful scrutiny courts will apply to inter vivos transfers in an estate context and the ongoing relevance of resulting trust principles.
