Both the BC and Alberta vehicles involved in the collision were destroyed. Liability was initially contested, but after Mr. Yawney prosecuted the claim and took it to the eve of trial, liability was admitted and the claim resolved for over $800,000.00 plus the costs to prosecute the claim.

Brain injury claim resolves for more than $3,900,000.00 plus costs

Michael Yawney QC , along with Partner Ryan Irving and Associate Allison Jaquish took a complex mild traumatic brain injury claim to the brink of trial and resolved it for over $3,900,000 plus costs.

The plaintiff was injured when she was 11 years old when the vehicle she was a passenger in veered off the highway and down an embankment due to the negligence of the adult driver. The plaintiff was ejected from the vehicle and was found walking along the side of the highway with minor scrapes on her. The claim was complex because over the course of months after the collision it became apparent that something was wrong with the young girl. Mr. Yawney and his team had to retain occupational therapists and medical specialists to help the plaintiff, and the family. The provincial insurer provided little or no assistance to the family. Mr. Yawney did his best to push the claim through litigation and was able to obtain a reasonable settlement shortly before trial.

Mehmal v. Mehmal, 2018 BCSC 2057

Chris Hart acted as co-counsel for the Defendants, Audrey Christine Mehmal and the Estate of Walter Mehmal, in a trial commenced by Mr. Walter Mehmal’s brother, John Marshal Mehmal, who alleged that a trust existed with respect to the family ranch, where the beneficiaries were the Mehmal siblings. The Supreme Court accepted the Defendants’ arguments and found that a trust was never created, dismissing Mr. John Mehmal’s claim.

Sommerville v. Munro, 2018 BCSC 457 Damages Awarded $236,293

Chris Hart acted as co-counsel for the Plaintiff, Philip Sommerville, in a trial against ICBC with respect to Mr. Sommerville’s injuries. Mr. Sommerville was awarded $135,000.00 for non-pecuniary damages (ICBC had argued for less than $60,000), $64,584 for costs of future care (ICBC had argued for a minimal award), and damages for other amounts, totaling  $236,293.19.
